This policy explains how BazaarCo addresses intellectual property concerns on the Platform, including counterfeit products, unauthorized use of brand assets, and infringement involving listings, media, user content, or other marketplace activity.
This policy should be read together with the Terms & Conditions, Community Guidelines, Prohibited Products Policy, Seller Code of Conduct, and Product Listing Rules.
1. What This Policy Covers
This policy applies to alleged misuse or infringement involving:
- trademarks, trade names, logos, and brand identifiers;
- copyrighted images, videos, music, text, packaging, manuals, and creative works;
- product photos, promotional media, and listing content;
- patents, design rights, trade dress, or similar proprietary rights where applicable;
- counterfeit, replica, or imitation products; and
- other protected intellectual property rights recognized under applicable law.
2. BazaarCo's Position
BazaarCo respects the intellectual property rights of others and expects all Users to do the same.
Users must not:
- sell counterfeit, replica, pirated, or unauthorized goods;
- use another party's brand, logo, or trademark in a misleading or unauthorized way;
- copy listing photos, videos, descriptions, or other creative materials without the right to do so;
- upload pirated software, media, digital goods, or unlicensed content;
- misrepresent a product as genuine, official, licensed, or authorized when it is not; or
- use another party's intellectual property in a way that violates law, contract, or Platform policy.
3. Seller and User Responsibilities
Sellers and other Users are responsible for ensuring that content and products they upload, offer, or promote on BazaarCo do not infringe third-party rights.
This includes responsibility for:
- product authenticity;
- lawful sourcing;
- authorized resale where authorization is required;
- the right to use listing photos, videos, music, brand assets, and descriptive text;
- ensuring that creators, agencies, staff, or contractors acting on their behalf also comply; and
- promptly responding to BazaarCo inquiries concerning authenticity or rights ownership.
If you are unsure whether you have the right to use or sell something, do not list or upload it.
4. Merchant Responsibility for Uploaded and Migrated Content
Sellers on BazaarCo are independent businesses and are contractually required to ensure they possess ownership, valid licenses, brand authorization, distributor rights, or other lawful permissions for all images, descriptions, logos, catalog data, media files, and listing materials uploaded to their Stores.
This responsibility applies to regular listing uploads, bulk uploads, CSV, Excel, or JSON catalog imports, image URL imports, and migrations from external e-commerce dashboards or third-party platforms.
BazaarCo operates as a neutral marketplace platform. BazaarCo does not routinely cross-verify the legal ownership of uploaded media, catalog data, product descriptions, or migrated files before publication. Sellers remain responsible for ensuring that their uploads do not infringe third-party copyright, trademark, design, publicity, privacy, platform, contractual, or proprietary rights.
5. Counterfeit and Pirated Goods
Counterfeit, fake-branded, replica, pirated, or otherwise infringing goods are prohibited on BazaarCo.
Examples include:
- fake branded fashion, electronics, accessories, or cosmetics;
- goods using logos or packaging designed to imitate another brand deceptively;
- unauthorized software keys, cracked software, pirated media, or copied digital content;
- products falsely claiming official distribution, warranty, or brand approval; and
- unauthorized reproductions of branded, copyrighted, or protected designs.
Such products may also violate BazaarCo's Prohibited Products Policy.
6. Reporting an Intellectual Property Complaint
Rights holders or their authorized representatives may report suspected infringement to BazaarCo.
To help BazaarCo review the complaint efficiently, the report should include:
- Identification of the protected work: the specific copyright, trademark, brand asset, design, or other protected right claimed to have been infringed, including registration numbers where applicable;
- Identification of the allegedly infringing material: the exact URLs, product IDs, listing IDs, Store links, screenshots, or other BazaarCo locations containing the alleged unauthorized material;
- Contact information: the complainant's full legal name, company name where applicable, physical address, telephone number, and email address;
- Statement of good faith: a statement that the complainant has a good-faith belief that use of the material in the manner complained of is not authorized by the rights owner, its agent, or the law;
- Statement of accuracy and authority: a statement that the information in the notification is accurate and that the complainant is the rights owner or is authorized to act on behalf of the rights owner; and
- Signature: a physical or electronic signature of the rights owner or authorized representative.
Supporting documents, screenshots, registration records, authorization letters, product-authenticity evidence, and other relevant materials should be included where available.

BazaarCo may request additional information before taking action.
7. Platform Response and Safe Harbor Action
Upon receipt of a valid and sufficiently complete intellectual property complaint, BazaarCo may expeditiously remove or disable access to the disputed material while the matter is reviewed. BazaarCo follows marketplace notice-and-action and safe-harbor principles where applicable. Prompt removal or disabling of reported seller-uploaded content does not mean BazaarCo admits liability, confirms infringement, or validates every claim in the complaint.
BazaarCo may reject, delay, or request clarification for notices that are incomplete, inaccurate, abusive, unverifiable, or not submitted by a rights owner or authorized agent.
8. How BazaarCo May Respond
After receiving an intellectual property complaint, BazaarCo may:
- acknowledge the complaint;
- review the listing, Store, or content at issue;
- request clarification or supporting material from the complainant;
- request authenticity or authorization evidence from the Seller or User;
- temporarily restrict, hide, or remove the reported listing or content while the matter is reviewed;
- place payout or account-level holds where reasonably necessary; and
- decide the matter based on the available evidence, policy considerations, and applicable law.
BazaarCo is not required to leave reported content active while a credible infringement review is pending.
9. Seller or User Response to a Complaint
If BazaarCo contacts a Seller or User about a reported infringement, that Seller or User may be asked to provide evidence such as:
- invoices or source documentation;
- brand authorization letters;
- distribution or reseller authorization;
- proof of original authorship or license;
- trademark, copyright, or design ownership records; or
- any other documentation reasonably relevant to the complaint.
Failure to respond, or providing inconsistent or unreliable evidence, may lead BazaarCo to act based on the available record.
10. Potential Actions
Depending on the circumstances, BazaarCo may:
- remove or disable access to infringing content;
- remove or suspend a listing or Store;
- block specific products, keywords, images, or categories;
- hold or reverse payouts connected to the reported activity where justified;
- cancel affected Orders;
- issue warnings or policy strikes;
- suspend or terminate accounts; or
- refer serious matters to legal counsel, regulators, customs, law enforcement, payment providers, or other appropriate authorities.
Not every complaint will result in removal, and not every denial of a complaint means BazaarCo has validated the Seller's broader rights position.
11. Repeat Infringers and Serious Violations
BazaarCo may take escalating action against repeat infringers or serious one-time violators.
Examples of serious violations include:
- sale of counterfeit goods;
- systematic copying of another brand's catalog or content;
- repeated unauthorized use of brand assets after notice;
- large-scale piracy or digital infringement; or
- submission of fraudulent documents in response to an IP complaint.
For serious or repeated violations, BazaarCo may bypass warnings and proceed directly to suspension, payout hold, or permanent account termination.
12. Good-Faith Reporting
Users should report intellectual property concerns in good faith.
You must not knowingly submit false, abusive, retaliatory, or misleading infringement claims. BazaarCo may take action against misuse of the complaint process, including where a complaint is used primarily to harass competitors or suppress lawful listings.
13. BazaarCo's Own Intellectual Property
The BazaarCo name, logos, software, interface elements, design, content, and related materials are owned by BazaarCo or its licensors unless otherwise stated.
Users must not copy, reproduce, scrape, republish, distribute, reverse engineer, or commercially exploit BazaarCo's platform materials except as allowed by law or with BazaarCo's written permission.
14. Relationship to Other Policies and Law
This policy supplements, and does not replace:
- BazaarCo's Terms & Conditions;
- BazaarCo's Community Guidelines;
- BazaarCo's Prohibited Products Policy; and
- any intellectual property, unfair competition, consumer protection, customs, or criminal laws that may apply under Nepal or other relevant jurisdictions.
15. Changes to This Policy
BazaarCo may update this policy from time to time to reflect legal, operational, or marketplace changes.
The updated version becomes effective on the date shown at the top of this page.
